ASSUMPTION OF RISK & WAIVER OF LIABILITY

RELATING TO CORONAVIRUS/COVID-19

 

Xylem is excited to host the Xylem Reach Conference 2021 (the “Conference”) with people attending in person, and Xylem places as a top priority in-person attendees’ safety.  Xylem also recognizes the presence of the novel and highly contagious coronavirus (“COVID-19”).  To promote our attendees’ safety, Xylem is committed to following the COVID-19 guidelines and policies of the CDC, state and local government agencies, and Hilton Worldwide Holdings Inc. and its subsidiaries and affiliates (“Hilton”).  Xylem Inc. and its subsidiaries and affiliates (collectively, “Xylem”) have put in place measures to reduce COVID-19’s spread, but these measures cannot eliminate the risk of COVID-19 infection.

ASSUMPTION OF RESPONSIBILITY & RELEASE

By signing this agreement, you accept sole responsibility for all risks connected with exposure to COVID-19 upon entering the Hilton premises, attending the Conference, and/or traveling to or from either.  You also acknowledge that—whether a COVID-19 infection occurs before, during, or after your attendance—these risks can include personal injury, illness, permanent disability, death, damage, loss, claims, actions, liability, or related costs or expenses, to you or your family, successors, or assigns.  You also acknowledge that Xylem, Hilton, and their respective agents, visitors, volunteers, and their families cannot guarantee that you will not become infected with COVID-19 as a result of attending the Conference, and so you agree to release them from the risks of and losses related to any COVID-19 infection.

AGREEMENT TO COOPERATE

You also agree to cooperate with Xylem to promote in-person attendees’ safety from COVID-19.  Accordingly, you agree to comply with all rules, regulations, and guidelines imposed by (1) the City of New Orleans and Orleans Parish, Louisiana, (2) Xylem, and (3) Hilton, which may change during the Conference (collectively, “Safety Policies”).  These Safety Policies may include temperature testing; social distancing/maintaining at least 6 feet of distance between yourself and others at all times possible; washing/sanitizing hands; adhering to entrance/exit directions; and wearing personal protective equipment (PPE) (e.g., a mask/cloth face covering) as may be requested or required by Xylem.

AGREEMENT TO SELF-MONITOR

You also confirm that you do not have any COVID-19 symptoms as defined by the CDC.  If you experience any COVID-19 symptoms, you agree that you will refrain from attending the Conference, or from interacting with the attendees, or the personnel of Xylem or any other third parties who provide deliverables and/or perform activities, work, or services for or on behalf of Xylem or Hilton.
